The regular building inspection is just one element of the California Balcony Laws, SB 721 and SB 326. If the inspector finds any deviation from standards, you have a limited amount of time to resolve the issues and ensure that your elevated elements are safe for use. This legislation has stringent enforcement policies, so you could pay severe penalties if you fail to comply. You also run the risk of personal liability costs if an accident results.
The balcony laws identify two types of repairs each with stringent time frames. These are:
- Non-Emergency Repairs – The inspection report must be lodged within 45 days. Owners have 120 days to apply for a repair permit and 180 days to complete the repairs.
- Emergency Repairs – Access to the area is prohibited. Owners must arrange shoring to make the area safe until the repairs are completed and a follow-up inspection clears the area.
The HOA must notify the board and residents of any faults detailed on the inspection report.
